KEMETIC MINDS — BREAKING NEWS
August 25, 2026

The Supreme Court in Washington on Monday, in a 6-3 ruling, granted the Trump administration’s emergency request to implement key parts of an executive order restricting mail voting ahead of the November midterm elections, CBS News reported. The decision lifts a lower court’s injunction that had blocked implementation of the order’s provisions involving the Department of Homeland Security and the U.S. Postal Service in 23 Democratic-led states and the District of Columbia (CBS News, 2026).

Key Facts

  • The high court granted the emergency relief sought by the Trump administration after the Justice Department asked it to lift the injunction (CBS News, 2026).
  • In an unsigned decision, the court wrote that the states filed their lawsuit too soon and that “the Order itself does not harm the States, so the District Court lacked jurisdiction to bar the Government from trying to implement it” (CBS News, 2026).
  • The ruling clears the way for the Department of Homeland Security to move forward with a proposal to create lists of residents in each state who are eligible to vote (CBS News, 2026).
  • The decision does not preclude the states from filing lawsuits that challenge the policies the administration finalizes and puts in place in response to the executive order (CBS News, 2026).
  • The court cautioned that its action “does not mean that any measure taken by the Government to implement the Order will necessarily be lawful” (CBS News, 2026).

Ruling and Reaction

The emergency appeal arose after U.S. District Judge Indira Talwani sided with the group of states that challenged the executive order and ruled that the Constitution does not grant the president the authority to order changes to how they administer federal elections (CBS News, 2026). The Justice Department had asked the Supreme Court to lift the injunction late last month (CBS News, 2026). AP News reported the decision as the court siding with the Trump administration on mail-voting restrictions ahead of the midterms (AP News, 2026).

The White House called the decision “a major win for the security of American elections” (CBS News, 2026). White House spokeswoman Lauren Bis said: “These are commonsense measures that protect the security of mail-in ballots and ensure only Americans are electing American leaders. This Administration will continue to lawfully enact the agenda President Trump was elected on – which includes the safety and security of our elections” (CBS News, 2026).

Separate Legal Challenge

In a separate case involving voting-rights groups, Judge Talwani issued an order earlier this month that prevents the administration from implementing the executive order’s provisions directing the Postal Service to develop new procedures for mail ballots for the upcoming elections (CBS News, 2026). The Justice Department will likely argue that the Supreme Court’s decision applies to that case as well (CBS News, 2026).

What’s Still Unconfirmed

The Supreme Court itself stated that its ruling does not mean any measure the government takes to implement the order will necessarily be lawful, and that states remain free to challenge the policies the administration ultimately finalizes (CBS News, 2026). Whether the ruling will also apply to the separate case brought by voting-rights groups has not been decided. No other facts in the sourcing are unconfirmed.
