On Friday, a federal appeals court delivered a major blow to the administration’s mass-detention strategy, ruling that ICE’s policy of detaining nearly all undocumented immigrants is unlawful (WHYY, 2026). In the same 24-hour news cycle, a far-right British provocateur was arrested at a New Orleans airport, New York filed its first lawsuit against a sheriff defying a state anti-ICE law, and new data showed where enforcement is concentrating (Newsday, 2026; Police1, 2026; MSN, 2026).

• A split 3rd Circuit panel ruled that ICE’s mandatory detention policy violates the Fifth Amendment and federal immigration law (WHYY, 2026).

1. Deportations & Court Rulings

The U.S. Court of Appeals for the 3rd Circuit ruled Friday that ICE’s policy of detaining nearly all undocumented immigrants is unlawful, holding that it violates the Fifth Amendment’s Due Process Clause and federal immigration law (WHYY, 2026). The 2-1 ruling strikes at a July 2025 directive that calls for most undocumented immigrants to be held without bond hearings even when they have lived in the country for years and are pursuing legal status (WHYY, 2026).

The decision joins rulings from seven other federal appeals courts that have rejected the policy; two other circuits have upheld it (WHYY, 2026). The directive is a key strategy in the administration’s mass deportation campaign and has contributed to a surge in immigration arrests since President Donald Trump took office in January 2025 (WHYY, 2026).

Immigration attorneys have flooded federal courts with habeas corpus petitions challenging the policy, and federal judges have overwhelmingly ruled in their favor, WHYY reported (WHYY, 2026). The Justice Department did not immediately respond to a request for comment (WHYY, 2026).

“Even before the Trump administration began its campaign to detain every person it could round up, immigration detention was a cruel and unnecessary practice,” said Vanessa Stine, senior staff attorney at the ACLU of Pennsylvania (WHYY, 2026). Other wire reports on Friday described the policy as “unlawful” and said it “greatly expanded detention for migrants living in the country for years” (MSN, 2026).

2. Enforcement Actions

U.S. immigration officials arrested British far-right commentator Milo Yiannopoulos on Thursday at Louis Armstrong New Orleans International Airport, according to the Department of Homeland Security (Newsday, 2026). DHS accuses him of overstaying after entering the United States legally in May 2019 through New York City; an immigration judge issued a final removal order on July 22 after he failed to show up for his hearing (Newsday, 2026).

“He chose to overstay his welcome in violation of our nation’s laws,” a DHS spokesperson said (Newsday, 2026). ICE’s online detainee locator did not say where Yiannopoulos is being held, but directed family and legal representatives to the agency’s office in Alexandria, Louisiana, a deportation hub for international flights (Newsday, 2026). His representatives did not respond to a request for comment, and it was unclear whether he has legal representation (Newsday, 2026).

Yiannopoulos, a former Breitbart News writer who resigned in 2017 after a video of him endorsing pedophilia resurfaced, has been a vocal supporter of Trump’s immigration crackdown, posting last year: “Zero immigration for the next 20 years. No ifs, no buts” (Newsday, 2026). He has most recently worked for the rapper Ye (Newsday, 2026).

New enforcement data also shows ICE has arrested at least 2,440 people in San Francisco since President Trump’s second term began — the fourth-highest total for any city in California (MSN, 2026). In Florida, the Lee County Sheriff’s Office ranks second statewide for immigration encounters, while the Collier County Sheriff’s Office ranks first for arrests on local and state charges, according to data from the State Board of Immigration Enforcement (Yahoo, 2026).

The Florida data tracks encounters, federal immigration arrests, and local/state arrests, and includes unusual participants: the Florida Department of Lottery’s Division of Security reported over two dozen encounters, sixteen of which resulted in federal immigration charges, while the Palm Beach County School Board documented one (Yahoo, 2026).

3. Local & State Pushback

New York Gov. Kathy Hochul and Attorney General Letitia James announced Thursday that they are suing the Rensselaer County Sheriff’s Office for failing to comply with the state’s Local Cops, Local Crimes Act, which prohibits local agencies from maintaining 287(g) agreements with ICE (Police1, 2026). The suit, the first legal action brought by the attorney general’s new Office of Immigrant Trust, asks the court to order the sheriff to terminate the agreement and declare it void and unenforceable (Police1, 2026).

The law, signed by Hochul on May 26, required the 12 New York agencies with 287(g) agreements to unwind them by Aug. 25, 2026 (Police1, 2026). Rensselaer County Sheriff Kyle Bourgault, a Republican, has refused; at a Tuesday press conference he said the county jail “has identified (nine) that have been removed” since the agreement took effect in 2018 (Police1, 2026).

Caribbean immigration advocates praised the suit. “This lawsuit makes clear that no one is above the law, not even an elected sheriff,” said Murad Awawdeh, president and CEO of the New York Immigration Coalition (caribbeanlife.com, 2026). In New Jersey, anti-ICE protesters rallied in Montclair and Bloomfield after the latest arrests (Patch, 2026).

4. Detention & Facility Conditions

Rep. Joaquin Castro said ICE officials at the Dilley Immigration Processing Center in South Texas denied his request to visit Maria Rocio Rocha, the mother of a U.S. Naval Academy midshipman he appointed, even after Rocha faxed him written permission (Austin American-Statesman, 2026). “Despite the fact that I presented that form, they denied me the ability to see Maria, claiming that we needed 48 hours’ notice,” Castro said at a news conference (Austin American-Statesman, 2026).

“Again—as a U.S. member of Congress, I’m doing an official inspection, I’m trying to see somebody who is in this [center], who has given me permission to visit with her, and they were still denying me that,” Castro said (Austin American-Statesman, 2026). The visit came days after Victor Martinez Nieto and his 5-year-old son, Liam Tadeo, were deported to Mexico after ICE detained them on their way to a soccer game in Austin; Castro said his request to visit them was also rejected (Austin American-Statesman, 2026).

Separately, Curtis Wright, a 40-year-old Edmonton-born man who lived most of his life in the United States, says he endured “terrible conditions” at different ICE detention facilities in Texas after being taken into custody 10 months ago while returning from a work trip in Mexico (CBC, 2026). Wright lost his legal fight to remain with his two young sons and was returned to Canada on a removal order from a South Texas ICE processing center (CBC, 2026). “It drastically reduces my time and my ability to, you know, connect and be their father,” he said (CBC, 2026).

5. Policy & Funding

A new ACLU analysis argues that companies selling AI-assisted police report tools have a built-in incentive to distort what officers write — especially about their own surveillance products (ACLU News, 2026). It points to Vigilant Solutions, an automatic license plate reader company with a contract to share license scans with ICE, whose training slideshow recommended that police “leave mentions of license plate scanners out of their reports whenever possible” (ACLU News, 2026).

The finding was discovered by the Electronic Frontier Foundation’s Dave Maass in a trove of more than 1,800 pages that the ACLU of Northern California obtained through a FOIA lawsuit about the technology’s use and sharing with ICE (ACLU News, 2026). The article frames the case as an earlier example of the surveillance-to-report pipeline it warns about in products like Axon’s Draft One (ACLU News, 2026).

6. What’s Disputed or Unconfirmed

DHS’s account of the Yiannopoulos arrest and removal order has not been independently verified; his representatives did not respond to requests for comment, and it is unclear whether he has legal counsel (Newsday, 2026). The sheriff’s “nine removed” figure comes from Bourgault’s own press conference, not an independent audit (Police1, 2026).

Castro’s account of being denied access at Dilley is his characterization; ICE officials told him a 48-hour notice requirement applied (Austin American-Statesman, 2026). Wright’s description of detention conditions is his own testimony (CBC, 2026). The ACLU’s account of Vigilant’s internal guidance rests on documents it obtained through FOIA and the analysis of its own researchers (ACLU News, 2026). And the mandatory detention policy remains legally contested: two other appeals courts have upheld it, and the Justice Department has not responded (WHYY, 2026).
