KEMETIC MINDS — BREAKING NEWS
August 29, 2026

A federal judge on Thursday halted — at least for now — attempts to implement President Donald Trump’s executive order limiting mail voting, roughly a week before the first mail ballots are due to be sent out for the rapidly approaching midterm elections (AP, 2026). U.S. District Court Judge Indira Talwani blocked the government from implementing the order for 14 days, marking the second time she has stalled the directive (The Guardian, 2026).

Key Facts

  • The Supreme Court on Monday overturned an earlier ruling by Talwani that had blocked the order from taking effect, but the high court did not rule on the legality of the executive order (The Guardian, 2026).
  • The administration has since issued a formal rule governing whether the U.S. Postal Service will deliver states’ mail ballots, effectively restarting the legal fight (The Guardian, 2026).
  • The Postal Service says it will not deliver mail ballots unless states provide a list of voters who should receive them and format the envelopes in a certain way (AP, 2026).
  • Nearly one-third of Americans vote by mail, and election officials contend there is not enough time to revise their systems to comply with the new Postal Service directives (AP, 2026).
  • Trump issued the executive order in March targeting mail voting, his second related to elections since he returned to office (The Guardian, 2026).

Judge’s Reasoning

In her ruling, Talwani wrote: “Plaintiff states have neither time nor funds to design new mail ballots, seek approval of the new designs, order production of mail ballots, update their own election management systems, train election officials to use the USPS portal and upload citizen data to the portal, all before the midterms” (AP, 2026).

The latest ruling came in advance of a Sept. 3 hearing after Democrats and voting rights groups refiled their lawsuits to comply with the recent Supreme Court decision (The Guardian, 2026). Democrats and voting rights groups contend the Postal Service’s demand is unconstitutional, arguing that the Constitution grants states and, in some cases, Congress the power to make election rules — not the president or the Postal Service (The Guardian, 2026). The Guardian reports that this reasoning led courts to block Trump’s first executive order, issued last year, which sought to change election procedures such as requiring documentary proof of citizenship to register (The Guardian, 2026).

Reaction and Next Steps

The White House did not immediately respond to a message seeking comment (AP, 2026). The case could soon be appealed back to the Supreme Court, days after the justices handed down a procedural decision that allowed the administration to move ahead (AP, 2026). A hearing in the case is set for Sept. 3 (AP, 2026).

The Guardian reports that Trump has long targeted mail voting even though he uses it himself, and that he “falsely blames the system for his 2020 election loss” (The Guardian, 2026). A Brookings Institution report published in 2025 found that mail voting fraud occurred in about four cases out of every 10 million mail ballots cast (The Guardian, 2026).

What’s Still Unconfirmed

Whether the administration will appeal the new ruling to the Supreme Court has not been confirmed; AP reports the case “could soon be appealed back to the Supreme Court” (AP, 2026). The White House had not responded to a request for comment as of the time of the reports (AP, 2026).
