A federal judge in San Francisco late Thursday permanently barred the Trump administration from enforcing a set of rules aimed at cutting off artificial intelligence firm Anthropic from the federal government, ruling that the administration had unconstitutionally punished the company for protected speech (CBS News, 2026).

Key Facts

  • U.S. District Judge Rita Lin of San Francisco ruled that the administration’s actions violated the First Amendment, calling them “unlawful retaliation against Anthropic for constitutionally protected expressive activities,” and also found that the moves violated the company’s due process rights (CBS News, 2026).
  • Earlier this year, President Trump ordered federal agencies to stop using Anthropic’s AI model Claude, and Defense Secretary Pete Hegseth declared the firm a supply chain risk, aiming to prevent private defense contractors from using it to do work for the military (CBS News, 2026).
  • The dispute stems from Anthropic’s push to prevent Claude — which is used by the military — from being used for mass surveillance or fully autonomous weapons, while the military argued it should be allowed to use the model for all lawful purposes (CBS News, 2026).
  • Judge Lin wrote that Anthropic does not meet the legal definition of a “supply chain risk,” a designation typically used to prevent a foreign adversary from sabotaging a crucial U.S. system (CBS News, 2026).
  • Lin said her order does not require the government to use Anthropic or prevent it from giving another AI firm its business, “so long as those actions are consistent with applicable regulations, statutes, and constitutional provisions” (CBS News, 2026).

Ruling and Rationale

In a 59-page opinion, Lin rejected the administration’s national security justification for the actions. “The government is certainly owed deference on weighty issues of national security,” she wrote. “But Defendants’ contemporaneous words and deeds confirm that the challenged actions were based on a desire to make a public example out of Anthropic for its ‘arrogance’ in criticizing the government, not based on any articulable basis to believe that Anthropic would actually sabotage its model” (CBS News, 2026).

“The empty invocation of national security is not a blank check to punish and retaliate against government critics,” Lin continued (CBS News, 2026).

Reactions

The administration had argued the moves were necessary to safeguard national security (CBS News, 2026). An Anthropic spokesperson said: “We welcome the court’s ruling that this supply chain risk designation was unlawful. We remain focused on working productively with the government to harness AI for our national security so all Americans benefit from this technology” (CBS News, 2026).

The ruling follows a monthslong legal battle between Anthropic and the administration (CBS News, 2026). CBS News has reached out to the Pentagon and the White House for comment (CBS News, 2026).

What’s Still Unconfirmed

Neither the Pentagon nor the White House had publicly responded to the ruling as of the time of the CBS News report, and whether the administration plans to appeal has not been stated in the source (CBS News, 2026).
