2. Police Brutality: Police Knew 20-Year-Old Wanted to Die by Suicide Before Fatal Shooting, Denver Post Reports

Newly released records show Longmont police knew Dariss Yearby, 20, wanted to die by suicide before an officer fatally shot the unarmed man inside a Bluebird Drive home on Aug. 10.[2]

  • Dispatch told the first officer on the scene that Yearby was suicidal 10 minutes before the officer set foot in the home, body-worn-camera footage shows.
  • While Yearby held an 18-year-old woman against him, she shouted, “Please don’t shoot him … He’s lying because he wants to die. Please don’t.”
  • Seven seconds before the shot, another officer pulled out what appears to be a stun gun and asked, “Do you want to try a TASER?” No one answered him, the footage shows.
  • The officer shot Yearby in the middle of ordering him to “drop it” an eighth time, after at least seven prior orders, the footage shows.
  • Police did not find a gun when searching the room and bag, officials later confirmed.

3. ICE: ICE Releases Washington Man After Months in Colorado Detention

Rudy Villeda Mejía, a Honduran man with a pending T visa application, is home with his family in northern Washington after a federal judge ordered his release on Aug. 3, ending his cross-country ICE detention and deportation scare.[3]

  • ICE arrested Villeda Mejía at Denver International Airport on March 30, and he was held in Aurora, Colorado, until early August.
  • ICE moved Villeda Mejía to a Louisiana ‘staging facility’ — the final stop before ICE deports someone, according to his attorney, Henry Hollithron.
  • Judge Regina Rodriguez of U.S. District Court in Colorado ordered his release because he has a pending T visa application for victims of human trafficking.
  • Villeda Mejía’s stepson, Genaro Shaffer, said ICE flew him to Arizona and then Texas, and that he was driven from Texas to Louisiana.
  • Villeda Mejía’s passport and work permit remained in Colorado after his transfer, so he could not fly home from Louisiana, Hollithron said.

On Wednesday, Rep. Raja Krishnamoorthi led a roundtable with federal, state, and local elected officials, South Asian American lawmakers, and civil society groups to address rising hate crimes and discrimination against South Asian American communities.[5]

  • The roundtable included Representatives Pramila Jayapal, Ami Bera, Suhas Subramanyam, and Shri Thanedar, along with other state and local elected officials.
  • Civil society groups Indian American Impact and Stop AAPI Hate participated in the roundtable.

7. Hate Crimes: Man Accused of Driving Over Black Woman in Beloit Faces Hate Crime Charge

A Rock County Jail inmate with a history of hate crimes was charged for a third time this summer with assault by a prisoner with a hate-crime modifier after he allegedly threw his own feces on another inmate through a food tray slot on Aug. 28.[7]

  • The inmate is Thomas Edward Tuminskas II, 52, of Beloit.
  • Tuminskas allegedly yelled a homophobic slur at the fellow inmate, threatened to kill him, and used ‘other slurs and threats.’
  • In a May 7 incident, he allegedly threw a cup of feces and urine at a Black-Latino inmate and used a racial slur.
  • Tuminskas is jailed for allegedly running over a Black woman in a Beloit convenience store parking lot on April 26, with charges including attempted homicide with use of a dangerous weapon.

Looking Ahead

Looking ahead, Rudy Villeda Mejía remains home with his family in Washington while his T visa application — the basis for Judge Regina Rodriguez’s release order — stays pending. In Beloit, Thomas Edward Tuminskas II now faces a hate-crime charge for the Aug. 28 incident while still jailed on the attempted homicide case from April. And the NAACP awaits the response to its FOIA request demanding answers about the Justice Department’s plan to send more than 1,000 federal personnel to polling places.
